This Privacy Policy (“Privacy Policy”) describes how Komyu AI, LLC, a Michigan limited liability company (“Komyu AI,” “Company,” “we,” “us,” or “our”), collects, uses, processes, stores, discloses, and protects information in connection with our websites, applications, AI-powered phone agents, telephony services, analytics dashboards, integrations, and related services (collectively, the “Services”).
This Privacy Policy is incorporated by reference into and governed by the Master Services Agreement (“MSA”) or other applicable agreement between Komyu AI and the Client.
1. SCOPE & APPLICABILITY
This Privacy Policy applies to:
Business clients and their authorized users (“Client,” “you,” or “your”)
End callers and third parties who interact with AI phone agents operated by Komyu AI on behalf of Clients
Komyu AI provides Services exclusively to businesses. We do not knowingly provide Services directly to consumers for personal use.
2. DEFINITIONS
For purposes of this Privacy Policy:
“Client Data” means all data, content, scripts, prompts, instructions, business information, and materials provided or approved by Client.
“Call Data” means call recordings, transcripts, summaries, metadata, and related analytics.
“Personal Data” means information that identifies or relates to an identifiable individual, as defined by applicable law.
“Processing” means any operation performed on data, including collection, storage, use, analysis, transmission, or deletion.
3. INFORMATION WE COLLECT
3.1 Information Provided by Client
Komyu AI may collect information provided directly by Client, including:
Business and contact information
Account credentials and authorized user details
Scripts, prompts, workflows, logic, and configuration instructions
Menus, pricing, availability, FAQs, and operational data
Communications with Komyu AI, including support and optimization requests
Client represents and warrants that all Client Data is lawful, accurate, and authorized for use.
3.2 Information Collected Automatically
In connection with operation of the Services, Komyu AI may automatically collect:
Call metadata (timestamps, duration, routing, outcomes)
Call recordings, transcripts, and summaries (where enabled)
AI interaction logs and analytics
Telephony data associated with Komyu AI–provisioned phone numbers
System logs, performance metrics, and error data
Website usage, device, browser, and IP information
3.3 Sensitive Information
Komyu AI does not intentionally collect sensitive personal information (such as government IDs, financial account credentials, or passwords) unless:
Explicitly required for Service functionality, and
Expressly authorized by Client
4. HOW WE USE INFORMATION
Komyu AI processes information for legitimate business purposes, including to:
Design, configure, deploy, and operate AI phone agents
Provide call handling, intake, booking, analytics, and automation
Monitor system performance, reliability, and security
Provide customer support, optimization services, and troubleshooting
Improve and develop Services
Comply with legal and contractual obligations
Enforce agreements and protect Komyu AI’s rights
Komyu AI does not sell Personal Data.
5. AI PROCESSING & AUTOMATED DECISION-MAKING
The Services utilize artificial intelligence and automated systems.
Client acknowledges and agrees that:
AI systems are probabilistic and non-deterministic
Outputs may be inaccurate, incomplete, misleading, outdated, or fabricated
AI responses are not reviewed by humans in real time
Outputs depend on Client-provided data, approved configurations, and third-party platforms
AI outputs are provided for operational assistance only and are not a substitute for human judgment.
6. CALL DATA & RECORDINGS
Where enabled, Komyu AI may process call recordings, transcripts, and summaries for:
Core Service functionality
Quality assurance and system improvement
Client access, review, and analytics
Client Responsibility:
Client is solely responsible for:
Obtaining all required disclosures and consents for call recording, AI interaction, and automated communications
Compliance with call recording, wiretap, consumer protection, and communication laws
Komyu AI disclaims all responsibility for Client’s failure to obtain required consent.
7. OWNERSHIP OF SYSTEMS & TELEPHONY
All system architecture, software, workflows, prompts, logic, configurations, telephony infrastructure, and phone numbers used in connection with the Services are owned exclusively by Komyu AI.
Client has no ownership interest in Komyu AI systems or phone numbers, regardless of any data processed through the Services.
8. DATA SHARING & THIRD-PARTY PROCESSORS
Komyu AI may share information with third-party service providers solely as necessary to provide the Services, including:
Telephony carriers and communication providers
Cloud hosting and infrastructure vendors
AI model, analytics, and monitoring providers
Security, logging, and compliance vendors
Such providers process data under contractual obligations consistent with this Privacy Policy.
Komyu AI is not responsible for independent acts or omissions of third-party platforms beyond contractual control.
9. CLIENT COMPLIANCE OBLIGATIONS
Each party is responsible for compliance with laws applicable to its respective role.
Client is solely responsible for compliance with:
TCPA and consumer communication laws
Call recording and consent regulations
GDPR, CCPA, and other privacy laws
Industry-specific regulatory requirements
Komyu AI does not provide legal, regulatory, or compliance advice.
10. DATA SECURITY
Komyu AI implements commercially reasonable administrative, technical, and organizational safeguards designed to protect data.
However, no system can be guaranteed to be completely secure. Komyu AI does not guarantee absolute security and disclaims liability for unauthorized access beyond reasonable control.
11. DATA RETENTION
Komyu AI retains information only for as long as reasonably necessary to:
Provide and operate the Services
Fulfill contractual and legal obligations
Resolve disputes and enforce agreements
Maintain legitimate business records
Retention periods vary based on data type, configuration, and legal requirements.
12. DATA SUBJECT RIGHTS
Depending on applicable law, individuals may have rights to:
Access personal data
Correct inaccuracies
Request deletion
Object to certain processing
Requests may be submitted to support@komyu.ai.
Komyu AI may require verification and may deny requests where permitted by law or contractual obligation.
13. SERVICE SUSPENSION & DATA ACCESS
Komyu AI may restrict, suspend, or terminate Services or data access where necessary to mitigate legal, technical, security, or platform risk, consistent with contractual rights.
14. THIRD-PARTY LINKS
The Services may contain links to third-party platforms. Komyu AI is not responsible for third-party privacy practices or content.
15. CHANGES TO THIS PRIVACY POLICY
Komyu AI may update this Privacy Policy from time to time. Updates will be posted on this page. Continued use of the Services constitutes acceptance of the updated Privacy Policy.
16. GOVERNING LAW
This Privacy Policy is governed by the laws of the State of Michigan, without regard to conflict-of-law principles.
